Terms of Service

These Terms of Service ("Terms") govern your use of the StrataHub platform operated by StrataHub Pty Ltd (ABN 00 000 000 000) ("StrataHub", "we", "us", or "our"). By creating an account or using our services at stratahub.au (the "Platform"), you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Platform, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations, including the Australian Consumer Law. If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Description of Services
StrataHub provides a cloud-based strata management platform that includes:
- Portfolio and building management tools for strata managers.
- Notice creation, scheduling, and distribution to owners and residents.
- Amenity booking engine with approval workflows.
- Document library with folder management and access controls.
- Resident portal for owners and tenants to view notices, book amenities, and access documents.
- Team management and invitation system with role-based access controls.
- Reporting and analytics dashboards.
- Email notifications for key events and actions.
3. Account Registration
3.1 Creating an Account
To use the Platform, you must register for an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.2 Account Types
The Platform supports the following account roles:
- Organisation Admin: Full control over the organisation, including billing, team management, and all platform features.
- Portfolio Manager: Access to assigned portfolios and their buildings.
- Building Manager: Access to assigned buildings and their units, amenities, and residents.
- Owner: Access to owned units, building notices, amenity bookings, and documents.
- Resident: Access to unit information, building notices, amenity bookings, and public documents.
3.3 Account Security
You must notify us immediately of any unauthorised access to your account. We implement security measures including password hashing, account lockout after failed login attempts, and optional two-factor authentication for administrator accounts.
4. Subscription and Pricing
4.1 Pricing
StrataHub is priced at $2 AUD per unit per month, billed monthly. This price includes access to all platform features with no hidden fees, tier restrictions, or feature limitations. The total monthly charge is calculated as the number of units in your organisation multiplied by $2.
4.2 Billing
Subscription payments are processed securely through Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis. You will receive an invoice for each billing period.
4.3 Free Trial
New organisations may receive a 14-day free trial period. During the trial, you have access to all platform features. At the end of the trial, you must subscribe to continue using the Platform.
4.4 Cancellation
You may cancel your subscription at any time from your billing dashboard or by contacting support. Upon cancellation, your access will continue until the end of the current billing period. No refunds are provided for partial billing periods unless required by Australian Consumer Law.
4.5 Price Changes
We may adjust our pricing with at least 30 days' written notice. Price changes will take effect at the start of the next billing period after the notice period.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws.
- Upload or transmit malicious software, viruses, or harmful code.
- Attempt to gain unauthorised access to other users' accounts or data.
- Interfere with or disrupt the Platform's infrastructure or security.
- Use the Platform to send spam, unsolicited communications, or harassing content.
- Scrape, crawl, or use automated tools to access the Platform without written permission.
- Reverse engineer, decompile, or disassemble any part of the Platform.
- Share your account credentials with unauthorised third parties.
- Upload content that infringes on intellectual property rights of others.
6. Data and Content
6.1 Your Data
You retain ownership of all data and content you upload to the Platform ("Your Data"). By using the Platform, you grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the services.
6.2 Data Processing
We process Your Data in accordance with our Privacy Policy and applicable Australian privacy legislation. We act as a data processor on your behalf and will not use Your Data for purposes other than providing the Platform services.
6.3 Data Portability
You may request an export of Your Data at any time by contacting support. We will provide Your Data in a commonly used, machine-readable format within 30 days of the request.
6.4 Data Deletion
Upon termination of your subscription and after any applicable retention period, we will delete Your Data from our systems within 90 days, except where retention is required by law.
7. Intellectual Property
The Platform, including its design, code, features, documentation, and branding, is owned by StrataHub and protected by Australian and international intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Platform in accordance with these Terms.
8. Availability and Support
8.1 Platform Availability
We strive to maintain 99.9% uptime for the Platform. However, we do not guarantee uninterrupted access and may perform scheduled maintenance with reasonable notice. We are not liable for any downtime caused by factors beyond our reasonable control.
8.2 Support
We provide customer support via email at support@stratahub.au during business hours (Monday to Friday, 9:00 AM — 6:00 PM AEST). We aim to respond to all inquiries within 24-48 hours.
9. Limitation of Liability
To the maximum extent permitted by law, StrataHub's total liability to you for any claims arising from or related to these Terms or the Platform shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.
Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded or limited by law.
10. Indemnification
You agree to indemnify and hold harmless StrataHub, its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any third-party rights.
11. Termination
We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees, or engage in conduct that we reasonably believe is harmful to other users or the Platform. We will provide reasonable notice before termination where practicable, except in cases of serious breach.
Upon termination, your right to use the Platform ceases immediately. Sections 6 (Data), 7 (Intellectual Property), 9 (Limitation of Liability), 10 (Indemnification), and 13 (Governing Law) survive termination.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect by email or through the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
